1. Acceptance of Terms
By accessing or using cardots ("the Service", "the Platform") at cardots.net, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
cardots is operated by RT Design Studio SRL ("we", "us", "our"). We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.
2. Eligibility
You must be at least 16 years old to use cardots. By creating an account, you confirm that you meet this age requirement. If you are under 18, you must have parental or guardian consent.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information during registration and to keep your profile up to date.
You may not use another person's account without permission. You must notify us immediately of any unauthorized use of your account.
4. User Content
cardots allows you to post, upload, and share photos and associated content ("User Content"). You retain ownership of any content you create. By posting content on cardots, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the platform.
You represent and warrant that you own or have the necessary rights to share any content you post, and that your content does not infringe the intellectual property or other rights of any third party.
4A. Content from Third-Party Sources
cardots allows you to save content from external sources. When you save or upload content originally published elsewhere (via our browser extension or by direct upload), you represent that: (a) you own the rights to the content; (b) you have obtained permission from the rights holder; or (c) your use qualifies as fair use, fair dealing, or permissible citation under applicable law. You agree to include accurate attribution (source URL, author name where known) and to remove any content promptly upon request from the rights holder.
4C. Zero tolerance for objectionable content and abusive users
cardots maintains a strict zero tolerance policy for objectionable content and for abusive users. Objectionable content includes — without limitation — content that is illegal, harassing, threatening, defamatory, hateful, sexually explicit, gratuitously violent, infringing, fraudulent, or otherwise harmful. Users who post such content, or who harass, stalk, threaten, or otherwise abuse other members, will have their content removed and their account suspended or permanently terminated at our sole discretion. You may report objectionable content and abusive behavior through the in-app Report button on any dot, comment, or profile, or by writing to [email protected]. You may also block any user from your profile, which will immediately hide their content from your feed and notify our moderation team. Our team reviews reports and acts on confirmed violations within 24 hours.
4B. Indemnification
You agree to indemnify, defend, and hold harmless cardots, its operators, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) content you upload, save, or share; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights.
5. Prohibited Content and Conduct
You agree not to post, share, or engage in the following:
- Content that is illegal, harmful, threatening, abusive, harassing, or defamatory
- Content that infringes on the intellectual property rights of others
- Spam, unsolicited commercial messages, or automated bot activity
- Content that violates the privacy of others (e.g., personal information shared without consent)
- Impersonation of any person or entity
- Any content that promotes illegal activities
- Malware, viruses, or any code intended to damage or disrupt the Service
We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion.
6. Links to External Content
cardots allows users to associate photos with external URLs (links to car listings, social media profiles, events, etc.). We are not responsible for the content, accuracy, or availability of external websites. The inclusion of a link does not imply endorsement.
7. Chrome Extension
The cardots browser extension is provided to help users save content from around the web. It only accesses images and page metadata (Open Graph data) on pages where you actively interact with it. It does not collect browsing history, passwords, or any personal data beyond what is necessary to create a dot on your behalf.
8. Intellectual Property
The cardots platform, including its design, logo, and software, is the property of cardots and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our explicit written permission.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, cardots is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Termination
You may delete your account at any time from your account settings. We reserve the right to suspend or terminate your account for violations of these Terms without prior notice.
Upon account deletion, your public content (dots, collections, comments) will be removed from the platform. Some data may be retained for a limited period as required by law or for legitimate business purposes.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Moldova, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Moldova.
12. Copyright Infringement Claims
If you believe content on cardots infringes your copyright, please submit a notice via our Copyright Policy at cardots.net/copyright. We respond to valid notices within 48 hours and will remove infringing content promptly. Users subject to takedown notices may submit a counter-notice as described in the Copyright Policy.
13. Repeat Infringer Policy
cardots enforces a three-strike policy for repeat copyright infringement. Users who receive three valid takedown notices within a 12-month period will have their accounts permanently terminated. Strikes expire after 12 months of good standing.
